Champimom Circle Terms of Use

Welcome to Champimom Circle, a community designed to connect parents, caregivers, and families to share experiences, advice, and support. By accessing or using Champimom Circle (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with these Terms, you may not use the Platform.

1. Acceptance of Terms

   By registering for an account, accessing, or using the Platform, you confirm that you are at least 18 years of age and agree to comply with these Terms. If you are under 18, you must have parental or legal guardian consent to use the Platform. You also confirm that your use of the Platform complies with the laws of the Hong Kong Special Administrative Region ("HKSAR").

2. User Conduct

   You agree to use Champimom Circle responsibly, respectfully, and in accordance with all applicable HKSAR laws, including but not limited to the Personal Data (Privacy) Ordinance (Cap. 486), the Defamation Ordinance (Cap. 21), and the Telecommunications Ordinance (Cap. 106). You will not:

   Post or share content that is unlawful, defamatory, libelous, obscene, harassing, threatening, or otherwise objectionable under HKSAR law.

   Share sensitive information, including but not limited to personal data as defined under the Personal Data (Privacy) Ordinance (Cap. 486), such as identity card numbers, financial information, medical records, or other private details that could harm individuals if disclosed.

   Share confidential information, including trade secrets, proprietary information, or any data subject to confidentiality agreements or legal protections.

   Post or share content that is intended to harm, defame, or damage the reputation of any public or political figure, including statements that are malicious, false, or inflammatory, in violation of the Defamation Ordinance (Cap. 21) or other applicable laws.

   Engage in spamming, phishing, distributing malware, or any activity that compromises the security of the Platform or its users, including violations of the Telecommunications Ordinance (Cap. 106).

   Impersonate another person or misrepresent your identity or affiliation.

   Violate intellectual property rights, including copyrights, trademarks, or patents, as protected under HKSAR law, including the Copyright Ordinance (Cap. 528).

   Use the Platform for commercial purposes without prior written consent from Champimom Circle.

   Engage in any activity that disrupts, interferes with, or harms the Platform or its users.

   Champimom Circle reserves the right to determine, at its sole discretion, what constitutes a violation of these conduct rules and to take appropriate action in accordance with HKSAR law.

3. Account Responsibilities

   Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at info@champimom.com if you suspect unauthorized access.

   Accuracy: You agree to provide accurate, current, and complete information during registration and to update it as necessary, in compliance with the Personal Data (Privacy) Ordinance (Cap. 486).

   Termination: Champimom Circle may suspend or terminate your account if you violate these Terms or engage in activities that harm the Platform, its users, or any third party, including the sharing of sensitive or confidential information or content targeting public or political figures.

4. Content Ownership and License

   Your Content: You retain ownership of the content you post, but by posting, you grant Champimom Circle a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display your content for the purpose of operating, improving, and promoting the Platform. You represent that you have the right to grant this license and that your content complies with HKSAR laws, including the Copyright Ordinance (Cap. 528).

   Prohibited Content: You agree not to post content that includes sensitive or confidential information or content that targets or damages public or political figures. Champimom Circle may remove such content and take appropriate action, including account suspension or termination, in accordance with HKSAR law.

   Platform Content: All content provided by Champimom Circle, including text, graphics, logos, and other materials, is owned by or licensed to Champimom Circle and protected by intellectual property laws under the Copyright Ordinance (Cap. 528) and other applicable HKSAR laws. You may not use Platform content without prior written permission.

5. Privacy

   Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information in compliance with the Personal Data (Privacy) Ordinance (Cap. 486). By using the Platform, you consent to the practices described in the Privacy Policy. You agree not to share sensitive personal information (e.g., Hong Kong Identity Card numbers, financial, or medical data) about yourself or others on the Platform.

6. Moderation and Content Removal

   Champimom Circle reserves the right to monitor, review, and remove any content that violates these Terms, including but not limited to sensitive information, confidential information, or content damaging to public or political figures, without prior notice. We are not responsible for any user-generated content, and we do not endorse any opinions expressed by users. Content removal will be conducted in accordance with HKSAR legal requirements.

7. Reporting Violations

   If you encounter content or behavior that violates these Terms, including the sharing of sensitive or confidential information or harmful content targeting public or political figures, please report it to us at info@champimom.com. We will investigate and take appropriate action, which may include content removal or account suspension, in compliance with HKSAR law.

8. Limitation of Liability

   To the fullest extent permitted by HKSAR law, Champimom Circle and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, profits, or reputation, or damages resulting from the unauthorized sharing of sensitive or confidential information by users.

9. Indemnification

   You agree to indemnify and hold harmless Champimom Circle and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your posting of content that violates the rights of others, including sensitive, confidential, or defamatory content, under HKSAR law.

10. Termination

    We may terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice, for any reason, including but not limited to violations of these Terms, such as sharing sensitive or confidential information or posting content that harms public or political figures, in accordance with HKSAR law.

11. Modifications to Terms

    Champimom Circle may update these Terms at any time. We will notify users of significant changes via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

    These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of the HKSAR. You agree to submit to the personal and exclusive jurisdiction of these courts for the resolution of any disputes.
